  1. Rickards v. Lothian,, the defendant was not liable, the damage was a wrongful act by a third party and there was no non-natural use of land.

    Perry v Kendricks Transport the defendant was not liable either unless the plaintiff could show that the act which caused the escape was of a kind which the defendants could reasonably anticipate and guard against: that this the plaintiff had failed to do, and the appeal failed
